GoodLife Foods B.V.  is a Dutch company located at Minervum 7035, 4817 ZL Breda, the Netherlands. GoodLife Foods has several subsidiaries and other entities affiliated with it in the EU. GoodLife Foods and its subsidiaries and affiliates as jointly referred to as “GoodLife Foods”.

GoodLife Foods is active in the European Economic Area (EEA) and we keep our data on servers in the EEA, unless stated otherwise.

  1. Applicability of this Privacy Statement

This Privacy Policy is applicable to all activities on the following websites (hereinafter: “Websites”) of GoodLife Foods:

GoodLife Foods is the data controller for all personal data processed via the Websites. Personal data may be transferred between the subsidiaries and entities of GoodLife Foods as defined in this Privacy Policy.

We may change provisions of this Privacy Statement from time to time. The applicable version of the Privacy Statement will be published on the Websites.

  1. Which personal data do we collect and for which purposes?

In this section we explain which personal data we collect, from whom from, why we process said persona data and how long we retain your personal data.

A substantial part of our Websites can be used without providing your personal data. For certain (parts of) Websites, it is however necessary for GoodLife Foods to process personal data.

4.1 GoodLife Foods processes personal data from users of Websites (“Users”):

  1. To ensure that you can use our Website(s), we process your session ID for up to 1 day after you visit to our Website. Our basis for processing the personal data is our legitimate interest to be able to show you the Website working properly and your interest to browse a functioning website. Your interests are safeguarded due to the very limited amount of data that is processed.
  2. To prevent cross site forgery, we process a token ID up to 1 day after your visit to our website. Our basis for processing the data is our legitimate interest to be able to adequately secure the learning platform. Your interests are safeguarded due to the very limited amount of data that is processed.
  3. To improve our Websites, we process the personal data mentioned below up to 2 years after their collection. Our basis for processing the data is our legitimate interest in improving our Websites. Your interests are safeguarded because the data processing is limited and you have the ability to opt-out.
    • User, browser and / or session ID
    • IP address and your general location based on your IP address
    • Information about your browser and device
    • The duration of your website visit and how you use our Websites
    • The date and time of your visit to our Website
    • Your searches on our Websites
    • How you found our Websites
    • Metadata about videos watched on our website (such as which videos you watched, how much you watched the video, how many times you watched videos and how you got to the video)

The above data can be shared with Google Analytics. They can store data outside the EEA but guarantee that they continue to comply with European privacy legislation.

4. If you register yourself for a newsletter on our website, we will, depending on the Website, process the data mentioned below until you unsubscribe. Our basis for processing the data is consent because you voluntarily sign up for the newsletter.

    • What kind of newsletters you wish to receive

You can unsubscribe from these newsletters by following the unsubscribe instructions included with each newsletter. Unsubscribing from the newsletter will not affect our ability to send you emails about important matters.

For sending the newsletters we use Mailchimp. We share your e-mail address with Mailchimp. Mailchimp is located in the United States and we concluded standard contractual clauses as approved by the European Commission. We cannot guarantee that your e-mail address will not be processed by security agencies in the United States in accordance with the laws of the United States. If you do not wish your e-mail address to be shared with Mailchimp, please do not register yourself for our newsletter.

5. If you participate in a giveaway or contest, we will process your e-mail address for the duration of the giveaway or contest. If you win the giveaway or contest, we process the personal data mentioned below up to 6 months after the prize has been shipped to you. Our basis for processing the data is consent because you voluntarily sign up for the giveaway or contest.

6. If you ask us a question or make a request, we will process the personal data listed below up to 2 years after we last had contact with you. We process your data to be able to respond to your question or request. Our basis for processing the data is consent because you voluntarily contact us and you fill in the personal data in the provided fields.

If you contact us, the personal data as mentioned above may be shared with other entities of GoodLife Foods group if that is necessary to answer or process your request.

7. If you file a complaint via a complaint page, we will process the personal data listed below up to 2 years after the complaint has been settled. Our basis for processing the personal data is our legitimate interest to be able to deal with the complaint.

    • E-mail address
    • Telephone number
    • Product information, quantity of products purchased, information where the product has been purchased
    • Nature of the complaint, including uploaded details (photo’s). Other information provided in the open fields

If you file a compliant, the personal data as mentioned above may be shared with other entities of GoodLife Foods group if that is necessary to answer or process your complaint.

8. Information that you freely share with us. You can choose to share information freely with us, for example when you leave a comment for us on social media, complete a survey or enter a campaign or competition organized by us. Our basis for processing the data is consent because you voluntarily contact us.

If you share personal data with us as mentioned above, that personal data may be shared with other entities of GoodLife Foods group if that is necessary to fulfil the purpose for which you shared personal data with us. For example, if you enter a competition we may share your personal data with the entity that organizes the competition.

9. We place tracking and advertising cookies if you visit certain of our Website and give us permission to do so in the applicable cookie notification. The cookies process the information below up to 2 years after the collection of the data.

    • The date and time of your visit to our website
    • Your video preferences if you watch our videos

The tracking cookies are placed by Facebook and Google. Facebook and Google can store the data outside the EEA but guarantees to comply with European privacy legislation.

4.2 You apply for a job with us

If you apply for a job with us, we will process the personal data mentioned below up to 4 weeks after completing the application procedure or up to 1 year if you request it. Our basis for processing the data is our legitimate interest to process your application.

  • Information about your availability and employability for work
  • Information provided in the appropriate open fields and information you provide to us during an interview

5. Sharing personal data
5.1 Processors we engage

We may ask others to assist in providing the learning platform or websites. These “Processors” can therefore process your personal data on our behalf. We agree with these Processors that they may only use your personal data to enable our Websites and services.

We use the following types of processors:

  • parties that host our Websites, store data and manage and maintain our servers and databases
  • developers of our Websites
  • research agencies and analytical software suppliers to improve our Websites and services
  • complaint management software
  • mail providers
  • marketing agencies
  • providers of relationship management software

    5.2 Sharing your data with third parties 

We only share your personal data with third parties if this:

  1. is described in this Privacy Statement and we have a valid basis for this;
  2. is reasonably necessary or appropriate to comply with legal obligations;
  3. is necessary to comply with legal requests from authorities;
  4. is necessary to respond to any claims;
  5. is necessary to protect the rights, property or safety of us, our users, our employees or the public;
  6. is necessary to protect ourselves or our users from fraudulent, offensive, inappropriate, or unlawful use of our services.

We will notify you immediately if a government agency makes a request relating to your personal data, unless we are not permitted to do so by law.

Our Websites may also contain links to websites of others. If you provide your personal data on these third party pages, the privacy policy of this third party applies. We are not responsible for the content of the privacy policy of these parties and the way in which these parties handle your personal data. We encourage you to review their privacy policy before providing any personal information to them.

5.3. Merger or sale (part) of the company

It may happen that we disclose, share, or transfer your personal data when we transfer (part of) our business. Examples include (negotiations about) a merger, sale of parts of the company or obtaining loans. We will of course try to limit the impact for you as far as possible by transferring personal data only when necessary.

We have implemented appropriate technical and organizational security measures to protect your personal data. These measures include, but are not limited to:

  • Physical and electronic measures designed to prevent unauthorized access, loss, or misuse of personal data as far as possible.
  • We use TLS (Transport Layer Security) technology to encrypt sensitive information or personal data, such as account passwords and other identifiable information about payments.
  • Where reasonably possible, backups of personal data will be made.
  • Sensitive information is only stored encrypted if possible.
  • Vulnerabilities in the software are dealt with as quickly as reasonably possible.

We would like to point out that absolute security for sending personal data via the internet or storing personal data cannot always be guaranteed. We advise you to consider this when deciding whether to give consent for processing your personal data.

Our Websites may contain links to other websites and services. In addition, our Websites can also provide advertisements from third parties. Third party websites and services can collect and retain information about you. If you provide your personal data to third parties, then we are not involved. We have no control over these sites or the activities of the third parties. In that case, the privacy policy of the third party applies. We are not responsible for the content of the privacy policy of these parties and the way in which these parties deal with personal data. We encourage you to review their privacy and security practices and policies before you provide personal information to them.

Right of access

You can also ask us to provide insight into the processing grounds, relevant categories of personal data, the (categories of) recipients of personal data, the retention period, the source of the data and whether we use automated decision making.

You may also request a copy of your personal data that we process. Do you want additional copies? Then we can charge a reasonable fee for this.

Right to rectification

If the personal data processed by us about you is incorrect or incomplete, you can request us to adjust or supplement the personal data.

If we grant your request, we will, to the extent reasonably possible, inform the parties to whom we provide information.

Right to erasure

Do you no longer want us to process certain personal data about you? Then you can request us to delete certain (or all) personal data about you. Whether we will delete data depends on the processing ground. We only delete data that we process based on a legal obligation or for the performance of the agreement if the personal data is no longer necessary. If we process data based on our legitimate interest, we will only delete data if your interest outweighs ours. We will make this assessment. If we process the data based on consent, we will only delete the data if you withdraw your consent. Have we accidentally processed data or does a specific law require that we delete data? Then we will delete the data. If the data is necessary for the settlement of a legal proceeding or a (legal) dispute, we will only delete the personal data after the end of the proceedings or the dispute.

If we grant your request, we will, to the extent reasonably possible, inform the parties to whom we provide information.

Restriction of processing

If you dispute the accuracy of personal data processed by us, if you believe that we have processed your personal data unlawfully, if we no longer need the data or if you have objected to the processing, you can also request us to restrict the processing of that personal data. For example, during the time that we need to assess your dispute or objection, or if it is already clear that there is no longer any legal ground for further processing of those personal data, but you still have an interest in us not deleting the personal data. If we limit the processing of your personal data at your request, we may still use that data for the settlement of legal proceedings or a (legal) dispute.

Right to data portability

At your request, we may transfer the data that we automatically process to execute the agreement or based on your consent, to you or another party designated by you. You can make such a request at reasonable intervals.

Automated individual decision making

We do not take decisions based solely on automated processing.

Right of restriction of processing and withdrawal of permission

If we process data on the grounds of a legitimate interest, you may object to the processing. If we process data based on your consent, you may withdraw that consent. For more information, please refer to the relevant processing purposes above.

Exercising your rights

You can send a request for access, correction, deletion, data transfer of your personal data or request for withdrawal of your consent or objection to the processing of your personal data to  privacynotice@glfoods.com.

To prevent abuse, we ask you to identify yourself adequately in the case of a written request for access, rectification, or erasure. You can do this by sending a copy of a valid proof of identity. Do not forget to screen off your citizen service number and passport photo on the copy.

We strive to process your request, complaint, or objection within a month. If it is not possible to decide within a month, we will inform you of the reasons for the delay and the time when the decision is expected to be made (no longer than 3 months after receipt).

Data Protection Authority

Do you have a complaint about our processing of your personal data? Please contact us. We are naturally happy to assist you. If we cannot come to a solution, you are also entitled to submit a complaint to the national privacy authority, in this case the Dutch Data Protection Authority. For this you can contact the Dutch Data Protection Authority via https://autoriteitpersoonsgegevens.nl. You are also free to submit a complaint to your local Data Protection Authority, who will then forward it to the Dutch Data Protection Authority.
